Job Description: The Court of Appeals is essentially a Court of Review. It hears appeals from the Common Pleas, County and Municipal Courts. Desicions are final except in cases involving Constitutional questions, cases of felony, cases in which it has original jurisdiction, and cases of public or great general interest.

Question 1: First I will make timely fair decisions that reach all of the issues raised by the litigants.  Second I will review court local rules and procedures to ensure that they are applied fairly so as not to exclude litigants.  Third I will work to help the community understand the court’s purpose.

Question 2: Trial experience or judicial experience are equally helpful.  An appellate court reviews cases which are a combination of procedural steps taken by counsel, rulings made by the judge, trial strategy applied by counsel, and the actions of the fact finder be it a jury or a judge/magistrate.

Question 1: Preparation:  Read and analyse case materials before oral argument.  Identify critical issues/facts and obtain answers during oral argument.  Leagal analysis:  careful analysis of the law and facts to ensure a well reasoned and just result.  Establish:  intake procedures to eliminate technical defects early and avoid delay.

Question 2:

Prior experience as a judge or magistrate is helpful but not essential.  An appelate judge needs to appreciate the difficulties of work as a trial judge in order to properly evaluate an appeal, especially where abuse of discretion is an issue.
